_l <br /> Section 1. Findings of Fact. The "WHEREAS" provisions above shall <br /> constitute findings of fact and are incorporated by reference as if fully set forth <br /> herein. <br /> Section 2. Land Uses Requiring Special Property Use Permits. For the <br /> initiation or operation of any of the following as a principal land use or an <br /> accessory use to any existing use anywhere within the areas designated by Map <br /> #15-1, a Special Property Use permit shall be required, subject to Review Process <br /> III as described in EMC Title 15: <br /> A. Food banks <br /> B. Tattoo parlors <br /> C. Body piercing <br /> D. Video game arcades <br /> E. Plasma donation centers <br /> F. Social service agencies, as defined by EMC 19.04.020 <br /> G. Parking lots <br /> H. Church <br /> I. Single room occupancy residences as defined herein <br /> J. Teen clubs as defined herein <br /> K. Community centers as defined herein <br /> L. Other potentially incompatible uses as determined by the Planning Director. <br /> For the uses described herein, no applications for building permits or land use <br /> applications, or any other permits or approvals of any kind including, but not <br /> limited to, business licenses, in any way associated with such facilities shall be <br /> accepted during the effective period of this interim regulation, no pending <br /> applications shall be processed further during the effective period of this interim <br /> regulation, and no permits shall be issued or approvals granted except as <br /> specifically provided herein during the effective period of this interim regulation. <br /> Section 3. Evaluation Criteria. During the interim period, those uses described <br /> in Section 2 shall not be permitted in the R-4 or R-5 zones within the areas <br /> designated by Map #15-1. During the interim period, those uses described in <br /> Section 2 within the B-2, B-3, C-1 or C-2 zoned areas within the areas designated <br /> by Map #15-1 shall be subject to the evaluation criteria contained herein, and <br /> shall be denied for failure to satisfy all of the following applicable criteria: <br /> A. The use shall not have a negative impact on the investment of the proprietors <br /> of businesses within, or property owners of buildings that house existing retail <br /> uses, restaurants, market-rate multiple family housing, offices, theaters, or <br /> public facilities including arenas, community meeting facilities, and <br /> government offices; and <br /> B. The applicant shall demonstrate that there is a need within the area designated <br /> by Map #15-1 for the proposed use and that there is not adequate opportunity <br /> elsewhere within the City to establish such use; and <br /> C. All of the General Evaluation Criteria specified in EMC 19.41.150.C. <br /> 4 <br />
