Section 4. Authority to Establish Conditions. The Hearing Examiner shall <br /> have the authority to attach conditions of approval to any of the uses listed in <br /> Section 2, as necessary to mitigate impacts from any such use on the downtown. <br /> Conditions may include hours of operation, additional design or development <br /> standards, or other limitations as deemed appropriate to mitigate impacts that <br /> would discourage the quality redevelopment of downtown. <br /> Section 5. Definitions. <br /> A. Section 4 of Ordinance #1671-89, as amended (EMC 19.04), is hereby <br /> amended by the addition of the following definition: <br /> "Single room occupancy residences" means a residential facility in which <br /> individual rooms are rented on a weekly or monthly basis and which provides <br /> common bathroom and/or kitchen facilities, or any dwelling unit than contains <br /> less than 500 square feet gross floor area. This definition does not include hotels, <br /> motels, or college dormitory facilities associated with a college or university as <br /> defined in EMC 19.04. <br /> B. Section 4 of Ordinance #1671-89, as amended (EMC 19.04), is hereby <br /> amended by the addition of the following definition: <br /> "Teen club" means a building, a part of a building, a room or a premises in which <br /> entertainment, either live or recorded, vocal or instrumental, is provided with or <br /> without dancing by customers or patrons under the age of 21 years, or that <br /> includes patrons under the age of 21 as well as adults. <br /> C. Section 4 of Ordinance #1671-89, as amended (EMC 19.04), is hereby <br /> amended by the addition of the following definition: <br /> "Community center" means a building, a part of a building, a room or a premises <br /> in which the primary purpose is to provide a place for persons to receive services <br /> typically provided by a social service agency. <br /> Section 6. Term. The interim regulation established by this Ordinance shall <br /> terminate six (6) months after passage unless earlier repealed or renewed according to <br /> law. <br /> Section 7. Severability. Should any section, paragraph, clause or phrase of this <br /> Ordinance, or its application to any person or circumstance, be declared <br /> unconstitutional or otherwise invalid for any reason, or should any portion of this <br /> Ordinance be pre-empted by state or federal law or regulations, this shall not affect <br /> the validity of the remaining portions of this Ordinance or its application to other <br /> persons or circumstances. <br /> 5 <br />
