ORDINANCE NO. 2816-04 <br /> AN ORDINANCE AMENDING THE MORATORIUM RELATING <br /> TO ADULT RETAIL BUSINESS USES, ORDINANCE NO. 2776-04, <br /> BY EXTENDING THE MORATORIUM FOR AN ADDITIONAL <br /> SIX MONTHS <br /> WHEREAS, the City Council does find: <br /> 1. The Council adopted a moratorium relating to adult retail business <br /> uses, Ordinance No. 2776-04. This was enacted to provide the City <br /> with a stop-gap measure enabling the City an opportunity to study the <br /> issues associated the siting and other regulation of such businesses, to <br /> prepare appropriate regulations and to avoid applicants possibly <br /> establishing vested rights contrary to and inconsistent with any <br /> revisions the City may make to its regulatory scheme as a result of the <br /> City's study of this matter; <br /> 2. The Planning Commission is currently reviewing the issue concerning <br /> the siting of such businesses and has yet to complete its review. Before <br /> the Council can take any action on this matter, it must allow the <br /> Planning Commission sufficient time to complete its review and <br /> provide the City Council with a recommendation; and <br /> 3. Ordinance No. 2776-04 is effective from July 21, 2004, through <br /> January 21. 2005. The City Council did hold a public hearing on the <br /> adoption of Ordinance No. 2776-04; and <br /> 4. RCW 35.63.200 and RCW 36.70A.390 and the City of Everett Charter, <br /> Article III, authorize the Council to enact moratoria on land use matters <br /> to preserve the status quo while new plans or development standards <br /> are considered and prepared; and <br /> 5. The Council wishes to preserve the status quo to allow time to consider <br /> whether additional land use regulations may be necessary or <br />
