appropriate to minimize the adverse social, economic or environmental <br /> impacts of such adult retail business facilities; and <br /> 6. The City's work plan for this matter entails the Planning Commission's <br /> review of the issue, a recommendation being made by the Planning <br /> Commission for the City Council's consideration, and consideration of <br /> this matter by the City Council; and <br /> 7. The current moratorium will expire as of January 21, 2005, unless <br /> further extended. An extension of the moratorium for an additional six <br /> month renewal period would extend the moratorium through July 21, <br /> 2005, without lapsing; <br /> WHEREAS, the City Council does conclude: <br /> 1. The City does have the authority to extend the moratorium; and <br /> 2. The City must extend the moratorium for an additional six month <br /> renewal period through July 21, 2005, to act as a stop-gap measure: (a) <br /> to provide the City an opportunity to further study the issues <br /> concerning the siting and other regulation of such adult retail business <br /> uses and prepare appropriate revisions to the City's regulations; and (b) <br /> to avoid applicants possibly establishing vested rights contrary to and <br /> inconsistent with any revisions the City may make to its regulatory <br /> scheme as a result of the City's study of this matter; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 3 of Ordinance No. 2776-04 which reads as follows: <br /> Term. The moratorium established by this Ordinance shall terminate six months <br /> after passage unless earlier repealed or renewed according to law. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> 2 <br />
