Term. The moratorium established by this Ordinance shall be for a period of six <br /> (6) months beginning on the effective date of this Ordinance July 21, 2004, through <br /> January 21, 2005. Provided this initial six (6) month period shall not lapse and this <br /> Ordinance shall continuously remain in effect for any one or more six (6) month renewal <br /> periods subsequently adopted. <br /> Section 2: Ordinance No. 2776-04 is hereby amended by the addition of the <br /> following section for the purpose of extending the moratorium for an additional six (6) <br /> month renewal period: <br /> Notwithstanding any language in this Ordinance, this Ordinance shall not lapse and shall <br /> be extended for an additional six (6) month renewal period from January 21, 2005, <br /> through July 21, 2005. During this period, the work plan shall be continued to be <br /> implemented which shall involve the review and study of the siting and other regulation <br /> of adult retail business uses together with the Planning Commissions consideration of the <br /> relevant issues with recommendations to the City Council followed by the City Council's <br /> consideration of the issue. <br /> Section 3. Should any section, paragraph, clause or phrase of this Ordinance, <br /> or its application to any person or circumstances, be declared unconstitutional or <br /> otherwise invalid for any reason, or should any portion of this Ordinance be pre-empted <br /> by State or Federal law or regulations, such decision or pre-emption shall not affect the <br /> validity of the remaining portions of this Ordinance or its application of other persons or <br /> circumstances. <br /> RAY S PHANSON, Mayor <br /> 3 <br />
