A. The use shall not have a negative impact on the investment of the proprietors <br /> of businesses within, or property owners of buildings that house existing retail <br /> uses, restaurants, market-rate multiple family housing, offices, theaters, or <br /> public facilities including arenas, community meeting facilities, and <br /> government offices; and <br /> B. The applicant shall demonstrate that there is a need within the area designated <br /> by Map #15-1 for the proposed use and that there is not adequate opportunity <br /> elsewhere within the City to establish such use; and <br /> C. All of the General Evaluation Criteria specified in EMC 19.41.150.C. <br /> is hereby amended to read as follows <br /> Evaluation Criteria. During the interim period, those uses described in Section <br /> 2 of this ordinance shall be subject to the evaluation criteria contained herein, and <br /> shall be denied for failure to satisfy all of the following criteria: <br /> A. The use shall not have a negative impact on the investment of the proprietors <br /> of businesses within, or property owners of buildings that house existing retail <br /> uses, restaurants, market-rate multiple family housing, offices, or public <br /> facilities including arenas, community meeting facilities, and government <br /> offices; and <br /> B. The applicant shall demonstrate that there is a need within the area designated <br /> by the map attached hereto as Exhibit A for the proposed use and that there is <br /> not adequate opportunity elsewhere within the City to establish such use; and <br /> C. All of the General Evaluation Criteria specified in EMC 19.41.150.C. <br /> Section 4. Section 5 of Ordinance No. 2803-04, which reads as follows: <br /> Definitions. <br /> A. Section 4 of Ordinance No. 1671-89, as amended (EMC 19.04), is hereby <br /> amended by the addition of the following definition: <br /> "Single room occupancy residences" means a residential facility in which <br /> individual rooms are rented on a weekly or monthly basis and which provides <br /> common bathroom and/or kitchen facilities, or any dwelling unit than contains <br /> less than 500 square feet gross floor area. This definition does not include hotels, <br /> motels, or college dormitory facilities associated with a college or university as <br /> defined in EMC 19.04. <br /> B. Section 4 of Ordinance No. 1671-89, as amended (EMC 19.04), is hereby <br /> amended by the addition of the following definition: <br /> "Teen club" means a building, a part of a building, a room or a premises in which <br /> entertainment, either live or recorded, vocal or instrumental, is provided with or <br /> 4 <br />
