ORDINANCE NO. 2832-05 <br /> An Ordinance Amending Ordinance No. 1671-89, as amended (EMC 19.02.020), <br /> Amending Ordinance No. 2107-95 (EMC 19.22.020), <br /> and Rezoning a Portion of the East Side of Rucker Avenue <br /> between Everett Avenue and Pacific Avenue <br /> from C-1 (General Commercial) to B-3 (Central Business District) <br /> WHEREAS, in accordance with Everett Municipal Code 19.41.160, an area-wide rezone <br /> was initiated for properties located on the east side of Rucker Avenue between Everett <br /> Avenue and Pacific Avenue, from C-1 (General Commercial) to B-3 (Central Business <br /> District); and <br /> WHEREAS, the Planning Commission conducted a public workshop on the proposed <br /> rezone on October 19, 2004, took public testimony, and discussed alternatives to include <br /> a larger area for consideration for potential rezoning and revisions to permitted building <br /> height; and <br /> WHEREAS, the Planning Commission discussed the matter again as a non-agenda <br /> discussion at its regular meeting on November 16, 2004, and decided to limit <br /> consideration of the rezone area to the east side of Rucker Avenue, between Everett <br /> Avenue and Pacific Avenue, with the understanding that the City would review zoning <br /> boundaries and permitted building height for a broader area in downtown following the <br /> completion of the 10-Year Update to the City's Comprehensive Plan; and <br /> WHEREAS, the Planning Commission held a public hearing on March 8, 2005, and <br /> considered public testimony regarding the proposed rezone and amendment to allowable <br /> building height regulations, and has recommended approval of the rezone; and <br /> WHEREAS, the City Council finds the following: <br /> A) The proposed rezone is consistent with the Everett Comprehensive Plan, based <br /> on the following: <br /> 1. The subject rezone area is currently developed and is zoned C-1 and has a <br /> Comprehensive Plan designation of 3.1, Central Business District; <br />
