The proposed rezone to B-3 with recommended allowable building height <br /> of 150 feet will establish consistent development standards for all B-3 <br /> zoned properties located between Hoyt Avenue and Rucker Avenue; <br /> NOW, THEREFORE, THE CITY DOES HEREBY ORDAIN: <br /> Section 1. The area located within the following described areas which is currently <br /> zoned C-1 (General Commercial) is hereby rezoned to B-3 (Central Business <br /> District). Further, the Everett zoning map as adopted by Ordinance No. 1671-89, <br /> as amended (EMC 19.02.020) is hereby amended to reflect the rezone of the <br /> property described in this Section from C-1 to B-3: <br /> Area 1: Lots 1 through 16 of Block 623 of the Plat of Everett; and Lots 1 through <br /> 8 of Block 669 of the Plat of Everett, together with Lots A and B of Block 669 of <br /> the Plat of Everett; together with all abutting public rights-of-way between said <br /> lots and the centerline of said abutting rights-of-way. <br /> Area 2: Lots 6 through 18 of Block 681 of the Plat of Everett; and Lots 1 through <br /> 16 of Block 719 of the Plat of Everett; together with all abutting public rights-of- <br /> way between said lots and the centerline of said abutting rights-of-way. <br /> Section 2. Map#22-1 (Maximum Building Height in B-3 Zone), adopted by Section <br /> 12 of Ordinance No. 2107-95 (EMC 19.22.020), is hereby amended by the Map <br /> attached hereto as Exhibit A. <br /> Section 3. Severability. Should any section, paragraph, clause or phrase of this <br /> Ordinance, or its application to any person or circumstance, be declared <br /> unconstitutional or otherwise invalid for any reason, or should any portion of this <br /> Ordinance be pre-empted by state or federal law or regulations, this shall not affect <br /> the validity of the remaining portions of this Ordinance or its application to other <br /> persons or circumstances. <br /> Section 4. Conflict. In the event there is a conflict between the provisions of this <br /> Ordinance and any other City ordinance, the provisions of this Ordinance shall <br /> control. <br /> Section 5: The City Clerk and the codifiers of this Ordinance are authorized to make <br /> necessary corrections to this Ordinance including, but not limited to, the correction of <br /> scrivener's/clerical errors, references, ordinance numbering, section/subsection <br /> number and any references thereto. <br />
