DEClSlON <br />Based upon the preceding Findings of Fact and Concfusions and testimony and <br />evidence submitted at the public hearing, it is hereby ordered that a Shoreline <br />Substantial Deve(opment Permit for the construction of an asphalt batch plant, a ready- <br />mix concrete plant, and a soils remediafion facility with a barge off-load faci(ity on a 22 <br />acre site at 17 East Marine View Drive, Everett, Washington, is granted. A Specia( <br />Property Use Permit for a baich plant to be located on-site is granted. A{andscape <br />modification from the landscape sfandards for an M-2 zoned property is granted. These <br />permits are granted subject to the fo{lowing conditions: <br />1. The proposed project shall satisfy policies and regulations of the City of Everett <br />Shoreline Master Program and be consistent with the application maferials <br />presented to the City. Any modificaiions �o the proposal are subject to review by <br />the Planning Director, who may approve the modification(s) as being <br />insignificant, or present the modification{s} to the Hearing Examiner_ If <br />presen"ted to the Hearing Examiner, helshe shall have discrefion to approve the <br />proposed modification(s) or reopen the hearing for additional public testimony. <br />2. Ail exterior fighting shall be directed downward onto the site and away from other <br />si�oreline properties or environmentally sensiiive site features. Lighting should <br />be kept fo a minimum (security lighting) at times �vhen there is na activity in the <br />yard. <br />3. All shoreline deveiopment shali comply with the City's noise ordinance (EMC <br />20.08). Compiiance shail occur both during and after consfruction. <br />4. A ien-foot wide, paved pub{ic access trail must be placed along the south and <br />west lot lines as shown on Exhibi� #2 prior to the operation of the faci{ity. ln the <br />event that the piers are not constructed by the time the facility begins operation, <br />a ten-foot wide, paved pubfic access trail must aiso be piaced along the entire <br />site. At the time the site becomes a"water dependent use" with the industriai <br />use of the proposed pier, the "shoreline" trail public access requirement shall <br />terminate. <br />5. An information ssgn with a standard state approved logo or other signs approved <br />by the Planning and Community Development Director that indicate the public's <br />right of access and hours of access shalf be constructed, installed, and <br />maintained by the Applicant_ Depending on the location and the operation <br />occurring on-site, the public �ccess may be controlied or restricted. Any change <br />of public access shali be reviewed by the ('lanning and Community Development <br />Direcfor_ An interpretive sign shall be provided to explain the ecologica[ <br />resources on fhe site. <br />17 <br />
