ORDINANCE NO. 3429-15 • <br /> An Ordinance <br /> Relating to Indigent Defense Services and Repealing Ordinance <br /> No. 3120-09 <br /> WHEREAS, <br /> A. RCW 10.101.030 requires cities to adopt standards for the delivery of indigent <br /> defense services. This statute provides that the standards endorsed by the <br /> Washington State Bar Association for the provision of public defense services <br /> "should serve as guidelines"to the City Council in adopting standards. <br /> B. Ordinance No. 3120-09 (EMC 2.108.230 through EMC 2.108.380) contains <br /> standards for indigent defense in the Everett Municipal Court. These standards <br /> are in many respects no longer current in light of the Washington State Supreme <br /> Court adoption of Standards for Indigent Defense, including Standard 3 thereof <br /> regarding case load limits. <br /> C. The Honorable Robert S. Lasnik of the Federal District Court for Western <br /> Washington in his decision in Wilbur v. Mt. Vernon, et al also provides guidance <br /> to cities regarding the provision of indigent defense services in the funding and <br /> evaluation of such services. <br /> D. The purpose of this ordinance is to update the Everett Municipal Code. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Ordinance No. 3120-09 (EMC 2.108.230 through EMC 2.108.380, inclusive) is <br /> hereby repealed in its entirety. <br /> 1 <br />
