ORDINANCE NO. 2845-05 <br /> An Ordinance approving an Amendment to the <br /> Comprehensive Plan Map designation from <br /> Single Family(1.1) to Community Business (4.2) on <br /> the two residential Properties at the Southeast Corner <br /> of 19th Avenue SE and 96th Street SE. <br /> The Clark Amendment. <br /> WHEREAS, the City of Everett adopted a new Comprehensive Plan in August, 1994, in <br /> conformance with the Washington State Growth Management Act; and <br /> WHEREAS, the Growth Management Act, codified as Chapter 36.70A, allows for <br /> comprehensive plans to be amended on an annual basis; and <br /> WHEREAS, the City of Everett initiated its 2004 annual comprehensive plan amendment <br /> process in July, 2004, which included consideration of Land Use Map amendments and rezone <br /> applications initiated by property owners; and <br /> WHEREAS, Mr. Clark submitted an application for an amendment to the Land Use Map for <br /> two properties located east of 19th Avenue SE on 96th Street SE, from Single Family(1.1) to <br /> Community Business (4.2), as indicated on the attached map (Exhibit "A"); and <br /> WHEREAS,the subject properties were located in unincorporated Snohomish County at the <br /> time of this action, the properties would therefore have to be annexed into the City before zoning <br /> could be applied; and <br /> WHEREAS, City Council held a public hearing to consider the request at which time it took <br /> additional public testimony and heard presentations from staff and the applicant on March 23, <br /> 2005 after which the City Council passed Resolution 5605 in support the application; and <br /> WHEREAS, City Council held a public hearing on July 20, 2005 to take further testimony and <br /> make the final decision as reflected by this Ordinance. <br /> - 1 - <br />
