WHEREAS, THE CITY COUNCIL FINDS: <br /> 1. The purpose for the requested Comprehensive Plan land use map amendment is to join the <br /> subject area to a larger area under control, or presumed to be under control, of the applicant <br /> such that it can be joined with other properties and developed as an integrated project. <br /> 2. The need for the proposed designation is to make it possible to join the subject site to property <br /> to the south, also controlled by applicant, thus creating the potential to access to 96th Street, <br /> and with it improved access to 19t Avenue (Exhibit "B"). <br /> 3. There is a change of circumstances in this area brought about by increased traffic volumes on <br /> 19th Avenue SE. <br /> 4. To achieve the indicated land use changes the City needs to amend the Comprehensive Plan <br /> Land Use map in the proposed area from Single Family(1.1) to Community Business (4.2), <br /> as indicated on the attached map (Exhibit "A"). <br /> 5. Land use policies of the Comprehensive Plan call for protecting and preserving residential <br /> lands and discouraging of conversion and encroachment of commercial uses into residential <br /> areas (policy 1.1.3). However there is an exception granted under 1.1.3 (d)which states, <br /> "conversion of residentially designated properties to commercial use may be permitted for <br /> the redevelopment of existing commercial uses where (ii) the commercial redevelopment is <br /> part of a unified commercial development that includes coordinated architectural design, <br /> drainage, and utilities. <br /> 6. The Planning Commission held two public hearings on the matter on February 1, 2005 and <br /> continued it to March 1, 2005 at which they continued public testimony, heard applicant and <br /> staff presentations and considered the various aspects of the proposal. <br /> 7. On March 1, 2005, the Planning Commission did recommend approval of the requested <br /> Comprehensive Plan amendment and rezone, subject to certain conditions. <br /> WEREAS CITY COUNCIL CONCLUDES: <br /> 1. The application provided information in support of this action showing the proposal is <br /> consistent with the Comprehensive Plan because it will enable development of a unified <br /> project. A sight obscuring fence will be provided so properties to the east will be screened, <br /> thus mitigating impact to nearby properties. <br /> 2. The public health, safety and welfare will be provided for by the proposal under existing <br /> development regulations of the City and proposed project site plan, if conditions set forth <br /> herein are followed; and <br /> - 2 - <br />
