located adjacent to 13th Street on the north and the south, for the purpose of facilitating <br /> pedestrian travel and patient care. <br /> B. Utility Corridor. Subject to the terms and conditions of this Ordinance, <br /> the City hereby grants permission to Providence to construct, maintain and operate a Utility <br /> Corridor under 13th Street, between Wetmore Avenue and Rockefeller Avenue within the <br /> horizontal area illustrated and legally described in Attachment A to this Ordinance, allowing for <br /> the delivery of utility services from Providence's utility building north of 13th Street with its <br /> hospital and other medical facilities north and south of 13th Street. <br /> C. Administration. The Director of Public Works or his or her designee(the <br /> "Director") shall administer the provisions of this Ordinance. <br /> D. Definition of North Everett Regional Medical Center. For the purposes of <br /> this Ordinance, a"North Everett Regional Medical Center"is a regional medical center that(1) <br /> spans both sides of 13th Street between Wetmore Avenue and Rockefeller Avenue, (2) includes <br /> a"hospital" as defined under RCW 70.41.020(4) or successor statute, and (3) includes at least <br /> 750,000 square feet of hospital and supporting facilities floor area(excluding parking) <br /> Section 2. Compensation to City. As compensation to the City for the permissions <br /> granted under this Ordinance, Providence shall pay to the City a one-time payment in the amount <br /> of thirty thousand seven hundred and twenty dollars ($30,720) (the"One-Time Fee"). <br /> Providence shall pay the One-Time Fee within thirty(30) days after the City Council's adoption <br /> of this Ordinance. <br /> Section 3. Term. The permissions granted to Providence are effective as of the effective <br /> date of this Ordinance and expire fifty(50) years thereafter, unless terminated earlier pursuant to <br /> the provisions of this Ordinance. The permissions granted under this Ordinance will <br /> automatically renew for an additional twenty-five (25) years unless either party delivers, prior to <br /> the expiration of the initial fifty(50) year term, written notice to the other of its determination <br /> not to renew. <br /> 2 <br />
