Section 4. Use of Right-of-Way. Providence's use of the Pedestrian Skybridge and <br /> Utility Corridor and all permissions granted under this Ordinance are at all times subject to the <br /> right of the City to use 13th Street right-of-way for public travel, utilities, and other public <br /> purposes. Providence shall use the Pedestrian Skybridge and Utility Corridor and all permissions <br /> granted under this Ordinance in a manner that minimizes interference with the use by the City <br /> and the public of the 13th Street right-of-way. Providence shall at its sole expense conform to all <br /> applicable laws, regulations, permits or requirements of any public authority affecting the use of <br /> the Pedestrian Skybridge or Utility Corridor. Upon request, Providence shall deliver to the City <br /> copies of any such permits. <br /> Section 5. Protection of Utilities. Providence shall pay all costs of any protection, <br /> support or relocation of existing utilities deemed necessary by the owners of utilities affected by <br /> the Pedestrian Skybridge and Utility Corridor. Providence is solely responsible for any damage <br /> to any utilities due to the construction, repair, reconstruction, maintenance, removal or operation <br /> of the Pedestrian Skybridge or Utility Corridor. <br /> Section 6. Conflict with Future Installations of the City. <br /> A. Compatibility with Current City Plans. As of the effective date of this <br /> Ordinance, the City has no plans to widen or otherwise alter the City's improvements in the 13th <br /> Street corridor between Wetmore Avenue and Rockefeller Avenue. Based on current City plans <br /> as of the effective date of this Ordinance, there are no forseeable conflicts with public use of 13th <br /> Street that would be created by Providence's construction and use of the Pedestrian Skybridge <br /> and Utility Corridor. <br /> B. Interference Notice. If the City Council determines by ordinance that the <br /> space occupied by the Pedestrian Skybridge or Utility Corridor is necessary for any public use <br /> and benefit while Providence owns and operates a North Everett Regional Medical Center and <br /> that the Pedestrian Skybridge or Utility Corridor interferes with such public use and benefit, then <br /> the City shall deliver notice thereof to Providence (the"Interference Notice").
