• <br /> that identify the potential interference. The City shall deliver the Interference Notice no less than <br /> three (3) months prior to the scheduled commencement of the City's proposed improvement, <br /> alteration or use. <br /> C. Providence Election. Within ninety(90) days after delivery of the <br /> Interference Notice (the"Election Period"), Providence shall elect to either(1)modify, relocate <br /> or remove the Pedestrian Skybridge or Utility Corridor improvements at Providence's sole <br /> expense, so as to remove the interference to the City's satisfaction, or(2)reimburse the City for <br /> all added costs related to such interference, including without limitation added costs of design, <br /> construction, and installation. The Director may extend the Election Period at the request of <br /> Providence. If Providence elects (1), Providence shall commence work and shall diligently <br /> prosecute the modification, relocation or removal work to completion in accordance with a <br /> construction schedule reasonably established by the City. If Providence fails to commence, <br /> prosecute, and complete such work in accordance with such schedule, the City at Providence's <br /> sole expense may enter Providence's property and undertake the work on behalf of Providence. <br /> If Providence elects (2), Providence shall give the City satisfactory assurance of payment of <br /> added costs at the time Providence delivers the notice of election and Providence shall reimburse <br /> the City for such added costs within thirty(30) days after delivery of an invoice from the City. <br /> D. Effect of Failure to Make Election. If Providence does not duly deliver a <br /> notice of election during the Election Period, the City may, by delivery of written notice to <br /> Providence, make the election for Providence, in which case such City election is fully binding <br /> upon Providence. <br /> Section 7. Termination- Removal. <br /> A. Termination for Failure to Own and Operate North Everett Regional <br /> Medical Center. Except as provided for in Section 15, if Providence no longer owns and <br /> operates a North Everett Regional Medical Center, the City may at any time terminate all <br /> permissions granted to Providence under this Ordinance effective upon delivery of written notice <br /> to Providence. <br /> 4 <br />
