WHEREAS, the Planning Commission did make a recommendation to approve the requests with conditions following the March 1, 2005 public hearing; and WHEREAS, City Council held a public hearing to consider the request at which time it took additional public testimony and heard presentations from staff and the applicant on March 23, 2005 after which the City Council passed Resolution 5604 in support the application; and WHEREAS, City Council held a public hearing on July 20, 2005 to take further testimony and make the final decisions as reflected by this Ordinance. WHEREAS, CITY COUNCIL FINDS: 1. The purpose for the requested Comprehensive Plan land use map amendment and rezone is to make it possible for the Snohomish County PUD to formulate and act on changing circumstances derived from long range load growth projections at this location, in a predicable, orderly fashion over the next twenty years. 2. The need for the proposed rezone is to ensure the Snohomish County PUD will be able to meet energy demands over the long-term. 3. The Snohomish County PUD has made a convincing case for the purpose and need for such long term response to continued growth in the area served by the subject switching yard. 4. To achieve the request the City needs to; a. Amend the City's Comprehensive Plan map designation from Single Family(1.2) to Public Quasi Public Facilities (2.8). b. Add the Institutional Overlay zone to the property subject to approval of the Master Plan submitted with the application. c. Void the Special Property Use permit (#16-84)upon the date of validity of the proposed rezone Ordinance. 5. Comprehensive Plan Policy 1.11.4. calls for ECC to, "submit a detailed master plan that will be implemented through the use of the Institutional Overlay Zone which will provide long term predictability for the College and surrounding neighborhood." 2
