1. Allowing community sanctioned special event signage would provide a limited <br /> opportunity to improve flexibility for promotion of special events held at public facilities <br /> in Everett; and <br /> 2. The increased flexibility of the proposed regulation is in the best long-term interest of the <br /> Everett community; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. The following regulation is hereby established: <br /> A. Sign Display. Notwithstanding the provisions of any other City regulation, for a <br /> community sanctioned special event, temporary signs promoting the event are <br /> allowed as follows: (1) one temporary sign mounted on one façade of the public <br /> facility structure hosting the event, and (2) one temporary sign mounted on one <br /> façade of any hotel(s) or motel(s)promoting said event. Any such temporary sign <br /> may be displayed for up to 60 days immediately prior to and during the event without <br /> a permit and without limitation on the size of such a sign. For the purposes of this <br /> section"community sanctioned special event"means an event held for a limited <br /> period of time in a public facility located within the City of Everett, with the support <br /> of a Lodging Tax Advisory Committee or Tourism Promotion Area funding grant <br /> provided specifically for the event. "Public facility"means a facility owned or <br /> operated by a municipal or governmental entity. <br /> B. Sign Materials. The signs allowed under this Ordinance shall be made of a material <br /> durable enough to be maintained in a safe, neat and attractive condition for the time <br /> said sign is displayed. The City shall have the authority to require the sign to be <br /> immediately removed by the building and/or property owner at their sole expense if it <br /> does not comply with this standard or in the opinion of the City's Building Official <br /> endangers public safety. <br /> C. Removal. Any sign allowed under this Ordinance shall be removed from the <br /> premises no later than 48 hours of the conclusion of the community sanctioned <br /> special event or upon the lapse of the 60 day display period, whichever occurs first. <br /> D. Violation. A violation of the provisions of this Ordinance shall be subject to the <br /> City's Civil Enforcement Procedures as set forth in Chapter 1.20 EMC and any <br /> person, firm or corporation who violates any provision of this Ordinance shall be <br /> subject to said enforcement procedures. <br /> Section 2. Severability. Should any section,paragraph, clause or phrase of this Ordinance, <br /> or its application to any person or circumstance, be declared unconstitutional or otherwise invalid <br /> for any reason, or should any portion of this Ordinance be pre-empted by state or federal law or <br /> regulations, this shall not affect the validity of the remaining portions of this Ordinance or its <br /> application to other persons or circumstances. <br />
