• ORDINANCE NO, 3267-12 An Ordinance Relating to Public Works Projects and Amending Ordinance No. 2761-04 (EMC 3.80.050) and Ordinance No. 2726- 03 (EMC 3.84.030). WHEREAS, Ordinance No. 2761-04 (EMC 3.80.050) regulates authority to sign Change Orders on Public Work projects; and WHEREAS,Ordinance No. 2726-03 (EMC Chapter 3.84) contains the City's bid protest procedures; and WHEREAS,the City wishes to clarify Change Order authority and bid protest procedures to provide more efficient processes for Public Works projects by adopting this Ordinance and amending Ordinance No. 2761-04 and Ordinance No. 2726-03; NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: Section 1. Section 7 of Ordinance No. 2761-04 (EMC 3.80.050(F)),which reads as follows: Public Work of At Least Five Million Dollars City Council may by resolution authorize the Mayor or the Mayor's designee to direct the contractor to perform additional work and to execute Change Orders for a Public Work project whose original contract value is at least five million dollars. is hereby amended to read as follows: Public Work of At Least Five Million Dollars City Council may by resolution authorize the Mayor or the Mayor's designee to direct the contractor to perform additional work and to execute Change Orders for a Public Work project whose original contract value is at least five million dollars. If City Council does not adopt such a resolution,then the Mayor or the Mayor's designee is authorized to direct contractors to perform additional work and to sign Change Orders on a Public Work project where the original contract value is at least five million dollars to the extent the sum of the Change Orders do not exceed an amount equal to five hundred seventy-five thousand dollars plus five percent of 1
