which it considered the history of zoning and comprehensive plan decisions for the subject <br /> properties and heard comments from the property owners ,the neighborhood residents, and staff <br /> and <br /> WHEREAS, at the June 7, 2005 hearing the Planning Commission did make a recommendation <br /> to keep the B-2 zone in place on the two subject properties, subject to certain conditions, and to <br /> correct the split zone condition on the Legowik property by rezoning it from R-1 (Single Family) <br /> to B-2 (Community Business); and <br /> WHEREAS, City Council held a public hearing on July 20, 2005 to take further testimony and <br /> make the final decision as reflected by this Ordinance. <br /> WHEREAS, THE CITY COUNCIL FINDS: <br /> 1. The purpose for this action is to establish consistency between the Comprehensive Plan <br /> and the zone district and to remedy the split zone condition on the Legowik property, and <br /> 2. The first adopted Comprehensive Plan designation for the properties was established in <br /> 1971 and it shows the properties as "Single Family." <br /> 3. In 1990 the Growth Management Act (GMA) was created which requires zone districts <br /> and comprehensive plan designations to be consistent with each other. <br /> 4. The 1994 GMA Comprehensive Plan also designated the subject properties as Single <br /> Family. The 4300 block of Terrace Drive, is residential single family in character and it <br /> should be preserved and protected according adopted policies found in the <br /> Comprehensive Plan. <br /> 5. The desire of the City Council is to comply with State Law and make the Comprehensive <br /> Plan and zone consistent with each other. <br /> 6. For consistency to be present at the subject location either the Single Family(1.2) <br /> designation there now would have to be implemented by an R-1 zone or the B-2 zone <br /> there now would have to be supported by a designation of Mixed Use Commercial— <br /> Multi Family (4.4). <br /> 7. Due to the single family character of the affected area every step should be taken by the <br /> City to ensure the protection and preservation of this residential block from commercial <br /> intrusion. <br /> 8. In order to both protect the neighborhood from commercial intrusion and meet the <br /> interests of the broader Everett community, single family zoning on Terrace Avenue is <br /> the alternative with the best long term interest for the area. <br /> 2 <br />
