9. The rezone to R-1 (Single Family Detached Low Density) bears a substantial relation to <br /> the public health, safety and welfare. <br /> 10. The Comprehensive Plan amendment considered and declined in favor of this zoning <br /> action taken herein promotes the long term interests of the Everett Community. <br /> WHEREAS CITY COUNCIL CONCLUDES: <br /> 1. This Planning Commission sponsored action will be made consistent with the <br /> Comprehensive Plan provisions calling for protection of residential neighborhoods by the <br /> rezone action taken herein. <br /> 2. The public health safety and welfare will be best provided for by the rezone action <br /> contained herein, specifically; the City Council has determined that the existing Single <br /> Family(1.2) designation of the two subject properties should be left in place. <br /> 3. The rezone will not create pressure to make similar changes in nearby locations currently <br /> zoned B-2 (Community Business). <br /> NOW, THEREFORE, THE CITY COUNCIL DOES ORDAIN: <br /> Section 1: Approval <br /> 1. That zoning on the B-2 portion of the Legowik property located at 4325 Terrace Drive <br /> property, and all of the Martinis property located at 4331 Terrace Drive is hereby <br /> changed from B-2 (Community Business)to R-1 (Single Family). Staff is hereby directed <br /> to show on the zoning map of the City of Everett that the subject properties and affected <br /> Rights-of-Way to their center lines are henceforth zoned R-1. <br /> 2. Exhibits A and B are hereby made part of this approval and incorporated herein by <br /> reference. <br /> Section 2: The legal description of the area affected by this action is: <br /> See Exhibit B <br /> Section 3: Validity. <br /> Should any section, subsection, paragraph, sentence, clause or phrase set forth in this Ordinance <br /> or its application to any person or situation be declared unconstitutional or invalid for any reason, <br /> such decision shall not affect the validity of the remaining portions of this Ordinance or its <br /> application to any other person or situation. The City Council of the City of Everett hereby <br /> declares that it would have adopted this ordinance and each section, subsection, sentence, clause, <br /> phrase or portion thereof irrespective of the fact that any one or more sections, subsections, <br /> sentences, clauses, phrases or portions be declared invalid or unconstitutional. <br /> 3 <br />
