3. The proposed change in policy promotes a more desirable growth pattern for the <br /> community as a whole. The Restoration Element provides information to property <br /> owners and developers that is useful in evaluating options for property development and <br /> restoration. The amendments regarding the Marshland properties allow on-going <br /> activities to continue, while providing for more detailed restoration/land use planning. <br /> 4. The proposed policy changes are consistent with other existing plan policies. The <br /> SEWIP and SEWIP SO were incorporated by reference into the SMP and Comprehensive <br /> Plan. The proposed Shoreline Restoration Element is based upon that information, as <br /> well as information provided in the Snohomish River Basin Salmon Recovery Plan. The <br /> amendments to the Marshland designation are consistent with the Comprehensive Plan <br /> map designations and policies. Updating the SMP to incorporate the Comprehensive <br /> Plan goals and policies for critical areas will provide additional consistency between the <br /> documents. <br /> WHEREAS, the City Council finds that the proposed amendments to the SMP that will be <br /> incorporated into the Zoning Code, including the development regulations for buffers, <br /> compensatory mitigation, and the Conservancy Agriculture shoreline environment designation, <br /> are consistent with the criteria for amending the Zoning Code text as follows: <br /> 1. The proposed amendments are consistent with the applicable provisions of the Everett <br /> Comprehensive Plan. <br /> 2. The proposed amendments bear a substantial relation to public health, safety or welfare; <br /> and <br /> 3. The proposed amendments promote the best long term interests of the Everett <br /> community. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: Incorporation by Reference of Critical Area Goals and Policies <br /> Section 3.9 of Exhibit A to Ordinance No. 2600-02, which was incorporated into the Shoreline <br /> Land Use Element of the Comprehensive Plan, and which reads in part as follows <br /> Incorporation by Reference <br /> Consistent with WAC 173-26-190, and in response to the listing of salmon under the federal <br /> Endangered Species Act, the City hereby incorporates the following plans, goals, policies and <br /> studies into this Shoreline Master Program only insofar as they apply to areas within shoreline <br /> jurisdiction. These documents comprise the substance and procedures for regulating <br /> development in critical and sensitive areas within the City of Everett including development <br /> within the shoreline jurisdiction. While these documents have broader applications within the <br /> City of Everett, they are applied here as an essential element of the regulatory structure to <br /> address development proposals within shoreline jurisdiction. These regulations apply to all <br /> activities and uses in all environmental designations of the Shoreline Master Plan. <br /> 4 <br />
