2. An extension of the moratorium with respect to the Central Waterfront Planning <br /> Area will allow the City to complete the planning process and will act as a stop-gap measure <br /> preventing the establishment of vested rights that could be incompatible with the plans, policies, <br /> and regulations that the City may adopt as a result of that planning process. <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Findings of Fact <br /> The "Whereas"provisions of this Ordinance shall constitute Findings of Fact in support of <br /> Ordinance No. 3260-12 and Ordinance No. 3260-12 is hereby amended to include the "Whereas" <br /> provisions of this Ordinance. <br /> Section 2. Moratorium Shall Not Lapse <br /> Section 5 of Ordinance No. 3260-12 which reads as follows: <br /> Term <br /> This moratorium will end six months after the effective date of this Ordinance <br /> unless earlier repealed or renewed according to law. <br /> is hereby amended to read as follows: <br /> Term <br /> The moratorium established by this Ordinance shall be for an initial period of six <br /> months beginning on the date of passage, February 15, 2012, and ending on <br /> August 15, 2012. If Council extends the moratorium beyond the initial period of <br /> six months, the moratorium shall not lapse and shall continuously remain in effect <br /> for each successive extension period. <br /> Section 3. Moratorium Extension <br /> Ordinance No. 3260-12 is hereby amended by the addition of a new section to read as follows: <br /> Notwithstanding any language in this Ordinance, this Ordinance shall not lapse <br /> and shall be extended for an additional six month renewal period from August 15, <br /> 2012, through February 15, 2013. <br /> Section 4. Conflict <br /> In the event there is a conflict between the provisions of this Ordinance and any other City <br /> ordinance, the provisions of this Ordinance shall control. <br /> Page 2 of 3 <br />
