Circumstances related to the existing Parks and Recreation Element have changed sufficiently <br /> to warrant rewriting and updating the Parks Element because funding has evolved and <br /> management model of the Parks system has changed. (findings 1, 2, 4, 5, 6 and 7) <br /> 5. There are no erroneous assumptions or new information regarding this action known at the <br /> time this action was taken. (findings 1, 2 and 4) <br /> 6. The proposal is to amend the text of the Comprehensive Plan by revising Chapter 9,the Parks <br /> and Recreation Element. (findings 1, 2 and 3) <br /> 7. The public health, safety and welfare will be provided for by this text change. (findings 1, 2, <br /> 3, 4 and 7) <br /> 8. The proposed Comprehensive Plan text changes promote the best long term interest of the <br /> Everett Community. (findings 1, 2, 3, 4 and 6) <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Text of the Everett Comprehensive Plan is Hereby Revised. <br /> Ordinance No. 2021-94, as amended is hereby amended by replacement of the existing Chapter <br /> 9, Parks and Recreation Element in its entirety with the revised attached Parks and Recreation <br /> Element Exhibit A. <br /> Section 2: Incorporation. <br /> Exhibit A is hereby attached and made part of this approval. <br /> Section 3. Validity. <br /> Should any section, subsection,paragraph, sentence, clause or phrase set forth in this Ordinance or its <br /> application to any person or situation be declared unconstitutional or invalid for any reason, such <br /> decision shall not affect the validity of the remaining portions of this Ordinance, or its application to any <br /> other person or situation. The City Council declares that it would have adopted this Ordinance and each <br /> section, subsection, sentence, clause,phrase or portion thereof irrespective of the fact that any one or <br /> more sections, subsections, sentences, clauses, phrases or portions be declared invalid or <br /> unconstitutional. <br /> 3 <br />
