Circumstances related to the existing Parks and Recreation Element have changed sufficiently to warrant rewriting and updating the Parks Element because funding has evolved and management model of the Parks system has changed. (findings 1, 2, 4, 5, 6 and 7) 5. There are no erroneous assumptions or new information regarding this action known at the time this action was taken. (findings 1, 2 and 4) 6. The proposal is to amend the text of the Comprehensive Plan by revising Chapter 9,the Parks and Recreation Element. (findings 1, 2 and 3) 7. The public health, safety and welfare will be provided for by this text change. (findings 1, 2, 3, 4 and 7) 8. The proposed Comprehensive Plan text changes promote the best long term interest of the Everett Community. (findings 1, 2, 3, 4 and 6) NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Text of the Everett Comprehensive Plan is Hereby Revised. Ordinance No. 2021-94, as amended is hereby amended by replacement of the existing Chapter 9, Parks and Recreation Element in its entirety with the revised attached Parks and Recreation Element Exhibit A. Section 2: Incorporation. Exhibit A is hereby attached and made part of this approval. Section 3. Validity. Should any section, subsection,paragraph, sentence, clause or phrase set forth in this Ordinance or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this Ordinance, or its application to any other person or situation. The City Council declares that it would have adopted this Ordinance and each section, subsection, sentence, clause,phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. 3
