Section 15: The City of Everett will review the sewer system user charges at least annually and revise <br /> the rates as necessary to ensure that adequate revenues are generated to pay the costs of operation and <br /> maintenance including replacement and that the system continues to provide for proportional <br /> distribution of costs of operation and maintenance including replacement among users. <br /> Section 16: The City of Everett will notify each user at least annually of the rate being charged for <br /> operation and maintenance (including non-capital replacement) of the sewer collection and sewer <br /> treatment systems. <br /> Section 17: Ordinance No. 3096-08 (EMC 14.14.020) and 3156-09 (EMC 14.16.710, 711, 712 and <br /> 713) shall be repealed upon the effective date of this ordinance; provided that findings relating to <br /> sewer system costs under Ordinances 1976-93, 237-73, 627-79, 1264-86, 1437-88, 1538-88, 1538-88, <br /> 1834-91, 1871-92, 1933-93, 2142-96, 2189-96, 2366-99, 3096-08 and 3156-09 are incorporated herein <br /> for background purposes. <br /> Section 18: Metering Requirements. Washington State Department of Health Water Efficiency Rules, <br /> WAC 246-290-496, require every municipal water system with more than 1,000 connections to meter <br /> all services by January 22, 2017. The City of Everett may, at any time after the effective date of this <br /> ordinance and prior to January 22, 2017, convert existing flat rate services to metered service accounts. <br /> At such time, as a flat rate account is converted to metered, beginning with the next scheduled read <br /> date, the meter will be read and that account will be billed based on consumption and current rates for <br /> domestic metered accounts no later than the next billing cycle. <br /> Section 19: State Utility Tax. The Mayor is authorized to increase or decrease the water charges <br /> herein to reflect any change in the State of Washington tax on water system revenues (currently set at <br /> 5.029% of system revenues). <br /> Section 20: On April 1, 2014, and thereafter on a biannual basis, the Utilities Superintendent shall <br /> submit a review and report of the financial condition of the water utility and City Council shall <br /> consider adjustment of rates, based on then current costs including but not limited to changes in the <br /> AFSCME Labor Relations agreement wage provisions for the position of Utility Laborer. <br /> Section 21: Domestic water customers will be defined a follows: "All metered water customers, <br /> either single family homes or multi-unit dwellings, of which the primary use is that of a structure to <br /> house human residents for an extended period of time shall be considered residential customers for the <br /> purpose of water billing". <br /> Section 22: Irrigation water customers will be defined as follows: "All metered water services which <br /> provide water solely for the purpose of commercial or agricultural irrigation of crops or landscaping <br /> shall be considered irrigation accounts for the purpose of water billing". <br /> Section 23: Future Rate Increases. Future increases in the water rates charged herein (except the State <br /> of Washington tax on system revenues) may be increased by City Council resolution subject to public <br /> hearing and notice of publication thereof at least two weeks in advance of approval of said resolution. <br /> 2.5 <br />
