I. Capitalized Terms All capitalized terms used but not defined herein shall have the meanings ascribed to them in 24 CFR Part 92. In addition, the meanings of capitalized terms defined herein are qualified in their entirety by reference to the definitions contained in 24 CFR Part 92. II. PROGRAM REQUIREMENTS A. Uniform Administrative Requirements As required by 24 CFR § 92.505, the Agency shall conform its performance under this Agreement to the applicable parts of 2 CFR § 200 as they relate to the acceptance and use of Federal funds under this Agreement. B. Other Federal Requirements The Federal requirements set forth in 24 CFR § 92.350 are applicable to the Agency as a participant in the HOME Program. The requirements of that section include: 1. Nondiscrimination and equal opportunity; 2. Disclosure requirements; 3. Debarred, suspended or ineligible contractors; and 4. Drug-free workplace. The Federal nondiscrimination requirements set forth at 42 U.S.C. § 12832 and relating to race, color, religion, ethnic or national origin, gender, age and non-disqualifying handicaps also are applicable. C. Minority Outreach Pursuant to 24 CFR § 92.351(b), Executive Orders Nos. 11625, 12432, and 12138, and 24 CFR § 85.36(e), the Agency shall take affirmative action to encourage the use of minorities' and women's business enterprises (hereinafter "WMBE") in connection with the HOME-funded activities related to the Project. In order to meet this goal, the Contractor shall, for all its Project contracts funded wholly or in part with HOME funds, demonstrate a good faith effort to attain 7.7% WMBE participation. Pursuant to 24 CFR § 92.508(a)(7)(ii)(B), the Agency shall submit an annual report of all Agency contracts over $25,000 relating to the Project and funded by HOME funds.
