ALLEGATIONS OF AYPLICANT <br /> Point 1. The following are the special circumstances which apply to my <br /> property which deprive me of rights and privileges which are enjoyed by <br /> other properties ii the vicinity under the identical zone classification. <br /> A similar iequest was granted for the Forest Park Swim Pool. The structure is similar <br /> but not as hi h or as much area. Another variance was granted for Our Saviors Luthern <br /> Church with a similar shape. <br /> Point 2 . The variance Z am requesting will not be detrimental to the <br /> public welfare or injurious to the properties or improvements in the <br /> vicinity of a zone in which my property is located because : <br /> The building will have a narrow profile above the present height limit. It will taper <br /> from 40' wide to 0. The nearest properties are over 300' away on 2 sides only and face <br /> away from the proposed building. There �re no views in this direction to be disturbed. <br /> Point 3. 7f this variance is not granted, an unnecessary hardship will <br /> continue to the owner of this property, the cause of which is beyond <br /> his control because: <br /> The most important element in the new c,�sign requires a dynamic entrance and pla} area. <br /> The fabric .�tructure will add an esthetic focal point for the area. <br /> Point 4. So as not to grant a special priviley�, to me by the granting of <br /> this variance I submit the following conditions to be imposed so as not <br /> to cause inconsistencies with the limitation upon other properties in the <br /> vicinity and zone in which I am located. <br /> All elements except the entrance/play area are to conform to the 35' height restriction. <br /> t5 <br />
