ARTICLE 23 - LAYOFF <br /> 23.1 General. <br /> 23.1.1 In the event of a layoff by the City, the employees in the lowest rank will be laid off <br /> in the inverse order of their seniority. In the event of a vacancy in the department, <br /> an employee who has been laid off two years or less will have the first opportunity <br /> to fill said vacancy or vacancies in the order of their seniority in that position, <br /> provided that the person meets LEOFF medical requirements and passes an entry <br /> level polygraph covering the period of separation to the time of rehire. The City will <br /> notify such former employee by certified mail at the last address maintained in the <br /> personnel file of the employee. Failure to respond to such certified notice within 10 <br /> days of the postmark shall constitute rejection of the position. <br /> 23.1.2 In the event of a reduction in the number of supervisory positions, the City may <br /> demote temporarily the person or persons with the least amount of seniority in that <br /> classification. The person demoted will maintain rights to the position held. <br /> 23.1.3 In the event of layoff, reduction shall be in the reverse order of hiring and <br /> promotion. <br /> EVERETT POLICE MANAGEMENT ASSOCIATION <br /> PAGE 28 <br />
