RESOLUTION NO. 5870 <br /> A RESOLUTION establishing a policy regarding <br /> the use of City-owned facilities. <br /> WHEREAS, Washington state Constitution Article VII, Section 1 (Amendment <br /> 81) requires that property acquired through taxes be "for public purposes only"; and <br /> WHEREAS, Washington state Constitution Article VIII, Section 7 prohibits the <br /> giving of public property "to or in the aid of any individual, association, company or <br /> corporation;" and <br /> WHEREAS, over the years the Supreme Court of the state of Washington, in such <br /> cases as CLEAN v. Spokane, 133 Wn.2d 455 (1997), City of Tacoma v. Taxpayers, 108 Wn. 2d <br /> 679 (1987), Anderson v. University of Washington, 106 Wn. 2d 312 (1986) and Lassila v. City <br /> of Wenatchee, 87 Wn. 2d 804 (1978), has interpreted and clarified the above referenced <br /> Constitutional Articles and provisions; and <br /> WHEREAS, municipal authorities have wide discretion to permit, or refuse to permit <br /> particular uses of municipally owned facilities; and <br /> WHEREAS, RCW 42.17.130 generally forbids the use of public facilities for election <br /> and campaign purposes; <br /> NOW, THEREFORE, be it resolved by the City Council of the City of Everett <br /> that: <br /> 1. This policy addresses the use of City-owned facilities including meeting rooms, conference <br /> rooms, hearing rooms and the City Council Chambers. This policy does not cover the use of <br /> such facilities in the Edward D. Hansen Conference Center. <br /> 2. Usage of City department meeting and conference room facilities shall be restricted to that <br /> department's use or use by other City departments subject to the approval of the director of the <br /> department where the facility is located. These facilities are limited to governmental usage of <br /> the City and shall not otherwise be used. <br /> 3. Usage of the City Council Chambers facility shall be as follows: <br /> A. The first priority of the Council Chambers is for regular and special meetings of <br /> the City Council; and <br />
