u <br />The current building use and occupancy is no longer residential and not approved <br />for commercial. Permits are required to establish a legal occupancy. The structure <br />was posted as an "Unlawful Structure" due to it being altered contrary to law. <br />These conditions are in violation of: EMC 19.41.070, IBC 105.1, IPMC 106.1, <br />IPMC 108.1.4, which states; <br />EMC 19.41.070 Use permit. <br />The occupancy of any structure constructed for one type of use which is changed <br />to ar�other use which requires different zoning code or building code standards <br />shall not be approved until a use permit has been issued by the planning <br />department. The new use shall be reviewed by the planning department to <br />ensure that all zoning code requirements which apply to the new use are met. <br />The building official shall review the new use for compliance with the city's <br />building regulations, If the proposed use is required to be re�iewed through a <br />higher level of review process as set forth in Title I5, Local Project Review <br />Procedures, consideration of the use permit shall be included as part of such <br />review process. <br />2012 International Buildina Code, (IBC� <br />2012 International Propertv Maintenance Code, �IPMC) <br />as adopted in EMC, Chapter 16.005.010 <br />IBC, 105.1 Permit required, which states; <br />Any owner or authorized agent who intends to construct, enlarge, alter, repair, <br />move, demolish or change the occupancy of a building or structure, or to erect, <br />install, enlarge, alter, repair, remove, convert or replace any e%ctrical, gas, <br />mechanical or plumbing system, the installation of which is regulated by this <br />code, or cause any such work to be done, shall first make application to the <br />building o�cial and obtain the required permit, <br />IPMC 106.1 Unlawful acts. <br />It shall be unlawful for a person, firm or corporation to be in conflict with or in <br />violation of any of the provisions of this code. <br />IPMC 108.1.4 Unlawful structure which states: <br />An unlawfu/ structure is one that is found in who% or in part to be occupied by <br />more persons than permitted under this code or was erected, altered, or <br />occupied contrary to law. <br />s <br />F,verett Police Department, Code Enforce�nent Unit • 3002 Wetmore Ave • Everett, WA 98201 • 425-257-8560 <br />
