April 15, 2015 <br /> Lapoint; and Frank, resident of Everett Gospel Mission, spoke in <br /> opposition to the proposed ordinance. <br /> Bob Reese, Volunteers of America; Mark Soine; Laura McCarthy; and <br /> Gary Hatle spoke in support of the proposed ordinance. <br /> Council Member Stonecipher advised that the city received a letter from <br /> the ACLU, which makes an argument against the proposed ordinance on <br /> constitutional grounds. <br /> Deputy City Attorney David Hall stated that the proposed ordinance was <br /> drafted very carefully by the Legal Department to avoid infringing on <br /> anyone's constitutionally protected speech. <br /> Moved by Council Member Roberts, seconded by Council Member <br /> Stonecipher to table this item pending further discussion regarding <br /> implementation of the policy with the inclusion of representation <br /> from the City Council. <br /> Roll was called with all council members voting yes, except Council <br /> Members Moore, Murphy, and Gipson who voted no, and Council Member <br /> Bader who was excused. <br /> Motion failed. <br /> Moved by Council Member Moore, seconded by Council Member Murphy <br /> to amend the motion to increase the distance from a signaled intersection <br /> from 60 feet to 120 feet as suggested by the City Traffic Engineer. <br /> Roll was called with all council members voting yes, except Council <br /> Members Roberts, Gipson, Stonecipher and Tuohy who voted no, and <br /> Council Member Bader who was excused. <br /> Motion failed. <br /> 107 <br />
