Addendum Number 1 <br /> Amtrak and Sound Transit Rail Platform Construction and Special Inspection Services at <br /> Everett Station <br /> This Agreement entered into this day of , 2003 <br /> by and between the City of Everett, a municipal corporation under the laws of the State of <br /> Washington,hereinafter referred to as the "City," and Krazan&Associates, Inc., <br /> hereinafter referred to as the "Contractor." <br /> Witnesseth: <br /> Whereas, the City and Contractor entered into a Professional Services Agreement <br /> (Contract) dated September 6, 2002, for construction and special inspection services <br /> related to the rail passenger platform and track facilities for Amtrak and Sound Transit at <br /> Everett Station,which Contract provided that Krazan would be paid on a per <br /> test/inspection basis; and <br /> Whereas, the City and Contractor agree that additional construction and special <br /> inspection and testing services related to concrete inspection and compression testing of <br /> the rail platforms are required; and <br /> Whereas, the City and Contractor agree that although the price per test or inspection does <br /> not change,the additional construction and special inspections and test will result in more <br /> compensation th'an the maximum stated in the Contract; <br /> Now, Therefore, the City and Contractor mutually agree as follows: <br /> Section 1: Section 4B of the Contract which reads as follows: "The Contractor shall be <br /> paid such amounts and in such manner as described in Exhibit B" is amended to read as <br /> follows: "The Contractor shall be paid such amounts and in such manner as described in <br /> Exhibit B and B-1." <br /> Section 2: Section 4D of the Contract which reads as follows: "Total compensation, <br /> including all services and expenses, shall not exceed a maximum of Three Thousand, <br /> Three Hundred and Sixty dollars ($3,360.00)"is amended to read as follows: "Total <br /> compensation, including all services and expenses, shall not exceed a maximum of Five <br /> Thousand and Twenty dollars ($5,020.00)." <br /> Section 3: All provisions of the Contract not modified by this Addendum shall remain in <br /> full force and effect. <br /> 26 <br />
