Kimberly-Clark will construct,own, and operate the outfall under an <br /> agreement with the City of Everett, approved by City Council in 1999 . Per the agreement,the City <br /> purchased capacity in the outfall ("Joint Use Facilities")and requested the City be named on any easements <br /> for the Joint Use Facilities. The City needs to execute the easement to be a Grantee for this right-of-way. <br /> Terms,conditions and costs of the easement have been agreed to and the easement now needs to be signed. <br /> RECOMMENDATION (Exact action requested of Council): <br /> Authorize the Mayor to sign the DNR Aquatic Lands Easement No. 51-072799. <br /> MARKS/ OUTFALL)CCADNR easement.doc <br /> `2 <br />
