MEMORANDUM OF AGREEMENT <br /> City of Everett and the Alderwood Water <br /> and Wastewater District (AWWD) <br /> Everett Evergreen Pump Station and AWWD Pump <br /> Stations 1 & 2 <br /> Draft 02/10/03 <br /> THIS MEMORANDUM OF AGREEMENT is entered into by and between the <br /> Alderwood Water and Wastewater District(District), a utility district organized under the laws of <br /> the State of Washington and the City of Everett (City), a first-class charter city organized under <br /> the laws of the State of Washington, for the purposes of allocating responsibility between the <br /> District and the City for the study of certain water facilities improvements (Project) related to <br /> District and City facilities, including pump stations on Evergreen Way at Everett's Reservoir#3 <br /> site. <br /> RECITALS <br /> A. The City and the District have planned improvements to their respective pump stations at <br /> the Reservoir# 3 site. <br /> B. The City and District believe that it would be mutually beneficial to retain one consultant <br /> to do the study of improvements at this site. <br /> C. The District and the City desire, in this Memorandum of Agreement, to identify their <br /> respective responsibilities relating to the study phase of the Project. <br /> AGREEMENT <br /> For good and valuable consideration the receipt and sufficiency of which is hereby <br /> acknowledged,the parties agree to the following terms of this Memorandum of Agreement. <br /> 1. Project Description.
