1. <br /> ORDINANCE NO. <br /> AN ORDINANCE CONSENTING TO TRANSFER OF TELECOMMUNICATIONS FRANCHISE <br /> WHEREAS, the City granted Advanced TelCom, Inc., dba Advanced TelCom Group <br /> ("Franchisee"), a franchise to provide telecommunications services in the City in Ordinance no. <br /> 2510-01 on March 15, 2001; and <br /> WHEREAS, Franchisee filed for protection under Chapter 11 of the United States <br /> Bankruptcy Code to reorganize; and <br /> WHEREAS, GE Business Productivity Solutions ("Transferee"), a Georgia corporation and <br /> wholly owned subsidiary of General Electric Company, is willing to purchase the franchise from <br /> Franchisee("Transfer"); and <br /> WHEREAS, Franchisee asked the City to approve the Transfer; and <br /> WHEREAS, the City is willing to consent to the Transfer upon certain conditions; and <br /> WHEREAS, the City previously consented to the Transfer by adopting Ordinance <br /> 2660-02 on November 27, 2002; and <br /> WHEREAS, delays occurred in closing the Transfer; and <br /> WHEREAS, Ordinance 2660-02 expired on January 31, 2003; and <br /> WHEREAS, the City remains willing to consent to the Transfer upon certain <br /> conditions; <br /> is 9 <br /> Ordinance Consenting to Transfer of Telecommunications Ordinance <br /> Page 2 of 2 <br />
