b <br /> C. Practice Areas. BCG shall operate the practice areas at the golf course. <br /> D. Putting Green. BCG shall operate the putting greens in a suitable fashion. <br /> E. Golf Instruction. BCG shall have qualified instructors available. BCG shall <br /> provide instruction programs year-round for senior citizens, adults (men and <br /> women), and juniors as may be mutually agreed upon by BCG and the City, and <br /> which are consistent with the physical limitations of the Practice Areas. <br /> F. Standards of Operation. BCG shall operate the Facility in a professional, <br /> competent and cost effective manner, consistent with the management of other <br /> municipal golf courses of the same size and quality in the greater Seattle-Everett <br /> area and in accordance with BCG's response to the City's RFP (Exhibit D). The <br /> City shall be solely responsible for staffing and all costs in connection with the <br /> maintenance of the golf course, putting green and practice areas, buildings, paved <br /> areas, landscaping, and grounds and shall conform to the Minimum Maintenance <br /> Standards as set forth in Exhibit A attached hereto. The golf course shall be open <br /> for play according to the schedule established by the City, except when in the <br /> reasonable judgment of the City, after consultation with BCG, opening the course <br /> to play would not be in the best interest of the City. <br /> i. BCG recognizes that, although it is operating the Facility for profit, the <br /> City of Everett Parks and Recreation Department is organized and exists <br /> for the purpose of maintaining park and recreation facilities for the use an <br /> enjoyment of the general public. BCG, its agents and employees will <br /> devote its efforts toward rendering courteous service to the public with a <br /> view of adding to the enjoyment of the patrons of this recreational facility. <br /> ii. BCG shall operate and conduct the Facility in a business-like manner and <br /> will not permit any acts or conduct on the part of its employees that would <br /> be detrimental to the City's operation of the golf course. <br /> iii. Settlements of disputes with customers, in regard to merchandise or <br /> service, shall in the first instance be under the control of BCG and shall be <br /> settled in accordance with the policy prevailing in BCG's business. BCG <br /> must keep a written log of all customer complaints for City review. In the <br /> event that BCG is unable to settle such disputes to the entire satisfaction of <br /> the customer, the matter shall be referred to the City and the City shall <br /> have the right to make such adjustments as it may deem proper and may <br /> charge all such allowances and refunds to the accounts of BCG, who will <br /> abide by the City's decision. The City agrees that it will adjust any <br /> controversy in a reasonable manner. <br /> iv. BCG shall provide sufficient personnel to adequately staff the facilities at <br /> all times. <br /> v. BCG's staff is expected to dress appropriately for the function they <br /> perform. Clothing may not reflect any controversial, derogatory, or <br /> 3 <br />
