b <br /> agrees to hold the City of Everett, its officers, employees and agents harmless _ <br /> from all claims, valid or invalid,made to the City because of its obligations. <br /> BCG shall have the right to terminate any BCG employee in BCG's sole <br /> discretion. BCG shall not employ and shall not have any financial obligation <br /> whatsoever for any persons involved with the maintenance of the golf course, <br /> buildings and structures, parking lots and landscaping; all of these persons shall <br /> be employees of the City. <br /> BCG shall comply with all applicable state and federal labor laws. BCG shall at <br /> all times defend, indemnify, and hold the City, its officers, employees and agents <br /> free, clear and harmless from all actions, claims, demands, and expenses arising <br /> out of said laws, and rules and regulations that are or may be promulgated in <br /> connection therewith. <br /> BCG employees will be trained and are expected to adhere to appropriate <br /> customer service guidelines. At least one BCG employee on duty per shift must <br /> maintain a current card stating completion and passing of CPR, AED and first aid <br /> training. All employees of BCG also shall maintain any other health cards or <br /> required certification appropriate to their line of duties under this Agreement. <br /> Further, said employees shall conform to all rules and regulations now in force in <br /> the business of the City, as well as all rules and regulations as hereafter may be <br /> promulgated or put into operation by the City. BCG shall assist the City in the <br /> enforcement of such rules and regulations. BCG further agrees to be responsible <br /> for all acts, omissions or commissions of its employees. BCG shall have the right <br /> to regulate and fix the salaries, commissions, and bonuses of its employees. BCG <br /> shall furnish to the City all information desired by the City with respect to BCG's <br /> payroll. <br /> Any and all claims that may or might arise on behalf of said employees or BCG, <br /> while so engaged, or any and all claims made by a third party as a consequence of <br /> any negligent act or omission on the part of BCG or its employees, while so <br /> engaged on any work or services provided under the terms of this Agreement, <br /> shall be the sole obligation and responsibility of BCG. <br /> i. Employee Conduct <br /> BCG shall not permit the use of loud or profane language, boisterous, or <br /> any lewd or immoral conduct in or about the assigned building and <br /> Facility by the public, or its employees. BCG shall also ensure that <br /> neither BCG nor its employees shall engage in either religious or political <br /> activity while on duty at said Facility. BCG shall immediately contact the <br /> City's Police Department and report the presence of any disorderly <br /> persons. Further, it is agreed that all persons working in said concessions <br /> shall be neat and clean in appearance. <br /> ii. Employee Loans <br /> It is agreed that BCG will not make any loans or personal advances to <br /> itself or its employees out of moneys due to the City. <br /> 5 <br />
