6 <br /> - equipment and furniture and fixtures within the restaurant, custodial maintenance, <br /> golf cart lease and cart maintenance costs; the cost of all inventory (golf shop and <br /> food and beverage) held for resale as set forth herein, any utilities that are BCG's <br /> responsibility incurred in the operation of the Facility including telephone service, <br /> cable or satellite television, DSL or other services not included under City <br /> Responsibilities listed in Section 6. Provided, however, BCG shall not be <br /> responsible for the payment of real estate taxes, property taxes (other than BCG- <br /> owned property) and/or debt service attributable to any indebtedness secured by <br /> the Facility, the golf course, equipment, or any other property; these obligations <br /> shall remain the sole responsibility of the City during the Term of the Agreement. <br /> R. Liquor License. Subject to any relevant Washington Alcoholic Beverage Control <br /> ("ABC") licensing requirements, BCG will obtain a Class A and Class C liquor <br /> license within sixty (60) days after the effective date of this Agreement. It is <br /> BCG's responsibility to apply for, maintain, and renew all liquor licenses. All <br /> costs associated with the obtaining or renewal of a liquor license shall be solely <br /> the responsibility of BCG during the Term of the Agreement. <br /> S. Marketing Plan. BCG shall create and implement the annual marketing plan for <br /> the Facility as part of the Annual Budget and Program as set forth in BCG's <br /> response to the City's RFP (Exhibit D). The marketing plan for the Facility will <br /> include a program of editorial coverage, public relations, and promotion to <br /> increase public awareness of the Facility. The marketing plan shall include <br /> provisions for special events, paid advertising (including print, cable, interne, and <br /> radio), barter opportunities, direct mail, and media and public relations <br /> campaigns. BCG shall also coordinate and oversee other third party Contractors' <br /> work in connection with the design, content, layout and production of advertising <br /> and collateral materials for use in promotion of the Facility. BCG shall also <br /> design and coordinate the implementation of programs to solicit group outings at <br /> the Facility. BCG will, in the context of its preparation of the Annual Budget and <br /> Program, review the Green Fee rate structure, offering of annual and/or resident <br /> memberships (if applicable), play cards and other fee or pricing issues to the <br /> Facility and make appropriate recommendations to City for implementation. <br /> BCG understands and accepts that the fee structure may be subject to <br /> establishment and revision by action of the City Council. BCG's marketing plan <br /> shall be in conformance with the scope, depth, and sophistication as represented <br /> in the BCG's response to the City's RFP (Exhibit D). <br /> 6. CITY'S RESPONSIBILITIES: During the term of this Agreement, the City's <br /> responsibilities shall be as follows: The City shall permit BCG to occupy the Facility <br /> and cooperate with BCG to enable them to accomplish the tasks set forth in this <br /> Agreement. The City shall monitor and evaluate BCG's performance for compliance <br /> with terms of this Agreement; disburse payments of all fees, reimbursements, and <br /> incentive payments due to BCG in a timely manner; establish fees, rules and regulations; <br /> and to monitor the Facility for BCG's compliance with the terms of this Agreement. The <br /> City shall also be solely responsible for providing staff, materials and supplies related to <br /> the maintenance of the golf course, buildings, landscape, and grounds as well as all <br /> maintenance equipment for the foregoing.
