No person who conducts,operates or manages an overnight lodging facility shall <br /> knowingly permit use of the premises by any guest, visitor,lodger or tenant known or suspected <br /> to have committed a crime,or to be in violation of an existing court order while on the premises <br /> for which license under this chapter has been granted. <br /> Section 12: Chapter 25, Section 11 of Ordinance No. 295-74(EMC 5.100.110) which reads as <br /> follows: <br /> Grounds for refusing license. <br /> No license shall be granted to conduct,operate or manage any hotel, rooming house,lodging <br /> house, apartment house,or tenement house in the city to any person, firm or corporation, nor to <br /> the agent of any person, firm or corporation that has been convicted in any of the courts of the <br /> state or in any Federal Court under any of the provisions of the laws of the United States relating <br /> to prostitution,gambling,or the manufacture,possession,sale,barter,exchange,giving away, <br /> furnishing,or otherwise disposing of or keeping intoxicating liquor,nor to the use of or handling <br /> of narcotic drugs. <br /> Be and the same is hereby amended to read as follows: <br /> Grounds for refusing license. <br /> A. A license under this chapter may be denied to any person if the City Clerk, after <br /> due investigation,finds that the applicant has done any of the following: <br /> 1. Made any false statement on the application or omitted information required on <br /> the application; <br /> 2. Committed any felony within ten years preceding the application, the commission <br /> of which is directly related to the applicant's ability to operate the business for <br /> which this license is sought, such as crimes of moral turpitude or crimes <br /> pertaining to alcohol,controlled substance,prostitution, gambling, dishonesty or <br /> physical violence; <br /> 3. Employed a person who has committed any felony within ten years preceding the <br /> hiring of said person,the commission of which is directly related to the person's <br /> position of employment; <br /> 4. Exhibited conduct within the past five years in operating or managing the business <br /> of overnight lodging which would lead the city clerk to reasonably conclude that <br /> the applicant will not comply with ordinance requirements under this chapter; <br /> 5. Falsified any record,document or information required to be kept or submitted to <br /> the city by this chapter, or by rule or regulation prescribed thereunder; or <br /> 9 <br /> 1 . <br />
