2 <br /> 6. Violated any of the provisions of this chapter. <br /> B. If the Chief of Police finds that any licensee has violated or failed to comply with <br /> any provisions of this chapter,he/she shall make a written record of such finding and shall <br /> specify therein the particulars;and will inform the Everett City Clerk. Upon recommendation of <br /> the Chief of Police,the City Clerk may revoke, suspend,or refuse to issue a license for that <br /> business. This determination shall be made in consultation with the Police Chief and shall be <br /> based upon the severity of the violation(s). <br /> Section 13: Chapter 25 of Ordinance No.295-74(EMC 5.100)is hereby amended by the <br /> addition of the following section: <br /> Criminal Background Search Required. <br /> Every person to whom an overnight lodging license is issued under the provisions of this chapter <br /> shall conduct a criminal background search before hiring any employee,agent, or representative <br /> of the business to ensure continued compliance with the provisions of this chapter. <br /> Section 14: Chapter 25 of Ordinance No. 295-74(EMC 5.100)is hereby amended by the <br /> addition of the following section: <br /> Remedies cumulative. <br /> The remedies provided for herein for failure to comply with this chapter shall be cumulative and <br /> in addition to any other remedy at law. <br /> Section 15: Savings. Nothing in this ordinance shall be construed as abating any official action <br /> of the City now pending under or by virtue of any of the ordinances herein amended by the <br /> adoption of this ordinance or as waiving any right of the City under the policies, provisions and <br /> regulations amended by the adoption of this ordinance. <br /> Section 16: Severability. If any section,subsection,paragraph, sentence,clause or phrase set <br /> forth in this ordinance or its application to any person or situation be declared unconstitutional or <br /> invalid for any reason, such decision shall not affect the validity of the remaining portions of this <br /> ordinance or its application to any other person or situation. The City Council of the City of <br /> Everett hereby declares that it would have adopted this ordinance and each section,subsection, <br /> sentence,clause,phrase, or portion thereof irrespective of the fact that any one or more sections, <br /> subsections, sentences, clauses,phrases or portions be declared invalid or unconstitutional. <br /> Section 17: Third Party Liability. It is expressly the purpose of this ordinance to provide for <br /> and promote the health, safety,and welfare of the general public and not to create or otherwise <br /> establish or designate any particular class or group of persons who will or should be especially <br /> protected or benefited by the terms of this ordinance nor create any duty for the City. Nothing <br /> contained in this ordinance is intended nor shall be construed to create or form the basis of any <br /> liability on the part of the City,or its officers,employees or agents,for any injury or damage <br /> resulting from any action or inaction on the part of the City,its officers,employees or agents. <br /> 10 <br /> 12 <br />
