Exhibit A is <br /> the plan layout of 271 parking stalls of which 150 are available for County parking purposes. <br /> It is agreed by the approval of this license that the Snohomish County Facility <br /> Management Director has the authority to accept or deny any increases or decreases in the <br /> number of parking stalls for the County. <br /> When signed by both parties, the letter and exhibits will be deemed an amendment to the <br /> license and will be sent to the same parties as identified in paragraph 9. <br /> 2. CONSIDERATION. The County shall pay the City a monthly license fee on or before <br /> the first business day of each month as follows. Any increase in parking stalls from the 150 <br /> during the term of this license will be an additional charge of$5.00 per stall per month. <br /> Monthly Stalls Additional Monthly Rental Cost For Each <br /> Rental Parking Stall Added <br /> $750.00 150 $5.00 <br /> The monthly license fee will be sent to the following address or such other place as the <br /> City may from time to time designate in writing: <br /> Joan Olsen <br /> Everett Station Building Manager <br /> 3201 Smith Avenue <br /> Suite 131 <br /> Everett,WA 98201 <br /> If the license fee is, at any time, fifteen (15) or more days past due, the County will be <br /> charged a one-time late charge equal to a total of five (5) percent of the monthly license fee past <br /> due. Simple interest of twelve percent per annum shall accrue on any amounts delinquent more <br /> than thirty days. <br /> If the term of this license extends beyond the current County fiscal year, the obligations <br /> of the County in succeeding fiscalyears are contingent upon appropriation by the County Council <br /> of sufficient funds for this purpose in accordance with law. <br /> 3. TERM. The initial term of this license shall be for a period of eight months, beginning <br /> August 1, 2003, and ending March 31, 2004. This license may be terminated by either party with <br /> 30 days written notice. A pro rata portion of the license fee shall be refunded or credited toward <br /> amounts owing the City if the license is terminated by the City for any reason except for license <br /> fee being late as stated in Paragraph 2. Termination shall not affect rights of either party under <br /> any other paragraph in this agreement. <br /> 4. USE. County will have the exclusive rights to use and occupy the Premises from 6:00 <br /> a.m. to 6:00 p.m. Monday through Friday, for parking of permitted vehicles. The County will also <br /> be allowed non-exclusive use of the Premises for parking of permitted vehicles from 6:00 p.m. <br /> to 6:00 a.m. Monday through Friday, including weekends. The City warrants the Premises as <br /> structurally fit and designed for the parking of the passenger automobiles and light passenger <br /> trucks assigned to or owned by County employees. <br /> All vehicles authorized by the County to park on the Premises will display a parking <br /> permit in the front windshield. All parking permits will be purchased at the sole expense of the <br /> County and will be distributed by the County. <br /> 2 <br /> 25 <br />
