• <br /> plywood or hardi-board sheets shall be permitted. Brick or other compatible masonry <br /> treatment shall be permitted, subject to approval by the Planning Director. <br /> Roofing—dark charcoal colored 40 year architectural composition shingle <br /> roofing. <br /> Balconies—ornamental metal railings. <br /> Windows—vertically oriented windows typical of north Everett. Horizontally <br /> oriented windows shall not be permitted. All windows shall be encased in painted wood <br /> trim. <br /> Sliding doors for deck or balcony access—shall be designed to resemble French <br /> doors. All sliding doors shall be encased in painted wood trim. <br /> Front planters and steps—exposed concrete painted, stained or grey. <br /> Garage walls—painted, stained or grey concrete, with ornamental metal grillwork <br /> in the vent openings. <br /> ADA accessible ramp—painted, stained or grey concrete to match front planters. <br /> Architectural elements such as balconies, cantilevers, and eaves may encroach <br /> within side setback areas as provided by Section 19.39.150.0.3 of the Everett Zoning <br /> Code and within the alley right-of-way as provided by Title 13 of the Everett Municipal <br /> Code and by the International Building Code. <br /> 2.5 Violation—Enforcement. In the event of any action to enforce this <br /> Agreement by the City, or on account of any default or breach of this Agreement by <br /> RAL, RAL shall be responsible for the City's costs and attorneys fees. The venue for <br /> such action shall be in Snohomish County Superior Court. Further, if construction and <br /> use of the Property is found to be inconsistent with the terms of this Agreement, all <br /> entitlements to the R-5 zone shall be forfeited, and any use inconsistent with the R-5 zone <br /> shall be deemed a violation of the Zoning Code and be subject to all violation, <br />
