(n) SIGN CATEGORY: <br /> Sign Category C,with off-premise business park directional signs permitted through a <br /> comprehensive sign design plan approved by the City. No electronic message board signs shall <br /> be permitted except time and temperature signs only, and no billboards shall be permitted. <br /> (o) METAL BUILDINGS: <br /> The exterior of buildings may be constructed of Architectural Metal materials within the <br /> development on the Development Property subject to prior approval from the City. Such <br /> materials shall be of high quality and shall meet the architectural standards of the M-1 zone. <br /> Corrugated metal shall not be authorized. All metal materials shall be subject to review and <br /> approval by the Planning Director and samples of such materials may be requested by the City. <br /> PART THREE—GENERAL TERMS <br /> 3.1 SEPA. The provisions of this Agreement are subject to the City's SEPA MDNS <br /> determination(#99-037),which is incorporated herein by reference. <br /> 3.2 Duration. The term of this Agreement shall be twelve (12)years from the date of <br /> its execution by all parties; provided, however, that all of Rinker's obligations under Part One of <br /> this Agreement and the City's indemnity obligations in Sections 1.4 and 1.11 shall survive the <br /> termination of this Agreement. Rinker and FSA shall be entitled to apply for one (1) five (5) <br /> year extension of this Agreement. Such application shall be made in writing to the City's <br /> Planning Director explaining the reasons for such request. In authorizing any such extension, <br /> which shall be purely discretionary, the Planning Director is authorized to impose new <br /> conditions that are consistent with then existing City regulations and State and federal law. <br /> 2004 Revised Development Agreement <br /> 28 <br /> 8/23/2005 <br />
