5 <br /> 6.2.c. Develop Determination of Non-Significance(DNS) or a Mitigated Determination of <br /> Non-Significance (MDNS). This task will involve working with the City of Everett <br /> in developing a DNS or a Mitigated Determination of Non-Significance MDNS. <br /> We will assist the City in their threshold determination to establish the legitimacy of <br /> a DNS or MDNS. Appropriate mitigation measures will be developed for an <br /> MDNS, if appropriate. Also under this task,we will facilitate notice of application <br /> and required comment period processes. We assume that one comment period will <br /> be adequate for this project. We will assist the City in the adoption process of the <br /> MDNS. <br /> 6.2.d. Track SEPA with NEPA Process. Although NEPA and SEPA review have similar <br /> functions and requirements,both need to be implemented independently of each <br /> other. For instance, the proposed project will receive substantial federal funds as <br /> administered by FHWA. FHWA will need to make a federal decision on such <br /> funding. The release of such funds must be based on a well informed decision <br /> pursuant to NEPA. As such, the proposed project must also be evaluated and <br /> documented under NEPA. This task involves the work necessary to track both <br /> processes concurrent manner as possible. <br /> 6.2.e. Agency and Team Meetings. As with any public process and agency <br /> documentation, several meetings will be required. For this scope of work,we <br /> assume a total of five meetings will be required. <br /> 6.2.f. Biological Evaluation. The proposed project must comply with the Federal and <br /> State endangered species acts. We will make data inquiry requests to the <br /> appropriate agencies to develop a list of listed species, candidate species, and/or <br /> priority species to be considered in the Biological Evaluation(BE). Each species <br /> will be addressed in the BE; however, it is assumed that the project action area will <br /> not substantially overlap habitat of such species. Further, we assume that no site- <br /> specific field investigations will be required. Thus,the document will be more of <br /> an administrative BE than a detailed technical BE with substantive evaluation and <br /> analysis. <br /> TIME FOR COMPLETION <br /> All Phase II work under this contract shall be completed by July 31, 2004. <br /> MINIMUM NOTICE OF MEETING REQUIRING CONSULTANT <br /> PARTICIPATION <br /> Consultant will normally be given a minimum of 24-hour notice of required meeting attendance. <br /> ITEMS TO BE PREPARED AND/OR FURNISHED BY THE CONSULTANT <br /> Page 10 of 11 <br /> 1e <br />
