TO:8693 <br /> 7. Transfer of Property <br /> Effective January 1, 1995, the City of Everett shall transfer its Evidence Control function <br /> and all property, assets, fixtures, and equipment used to support the Evidence Control <br /> Unit's function to the Snohomish County Sheriff's Office which shall thenceforth perform <br /> all necessary evidence control services to support the law enforcement mission of both the <br /> • <br /> Everett Police Department and the Snohomish County Sheriffs Office in accordance with <br /> the terms and conditions set forth herein. <br /> If this agreement is terminated before the period during which the offset amount calculated <br /> in Section 5 above is to be paid, or April 1, 1998, whichever date occurs first, the County <br /> shall return to the-City all equipment and property previously transferred by the City to the <br /> County, The City recognizes that the physical condition of the equipment and property <br /> may have changed between the time it was transferred and the time of the cancellation and <br /> agrees that it will accept said equipment and property in the condition in which it exists at <br /> the time of cancellation, subject to normal wear and tear. <br /> If either party has received an offset payment as provided in Section 5 above, that party <br /> shall be entitled to retain that portion of the offset amount which is determined by <br /> multiplying the full offset amount by the ratio of the number of days that have passed in <br /> the period over which the offset amount was to be paid to the total number of days in the <br /> period over which the offset amount was to be paid. If the amount to be retained is less <br /> than the amount that the receiving party has received, the excess will be returned to the <br /> paying party, however, if the amount to be retained is greater than the amount the <br /> receiving party has received, the paying party shall pay the difference to the receiving <br /> party <br /> 8- Proceeds from Sales/AuctionsfTrades <br /> All proceeds from the combined Evidence Control Unit auctions, sales, or trades shall be <br /> divided between the City and the County according to the percentage formula established <br /> as Goal #1. Each party shall be responsible for disbursing its respective share according to <br /> the applicable state statutes. <br /> 9. Conversion / Retention <br /> Conversion or retention of property shall be in compliance with applicable State statutes. <br /> The agency which originally caused the property to be held in the Evidence facility shall <br /> have first right to convert, or retain such property for its exclusive use. <br /> i , <br /> City-Countg-Consolidated Evidence Facility Contract Page 5 <br />
