7 <br /> HOME funds or who are in a position to participate in a decision making process <br /> or gain inside information with regard to these activities, may obtain a financial <br /> interest or benefit from a HOME-assisted activity, or have an interest in any <br /> contract, subcontract or agreement with respect thereto, or the proceeds <br /> thereunder, either for themselves or those with whom they have family or <br /> business ties, during their tenure or for one year thereafter. <br /> 3. Persons Covered <br /> The conflict of interest provisions of paragraph 2 of this section apply to any <br /> person who is an employee, agent, consultant, officer, or elected official or <br /> appointed official of the Agency. <br /> 4. Exceptions: Threshold Requirements <br /> Upon the written request of the County, HUD may grant an exception to the <br /> provisions of paragraph 2 of this section on a case-by-case basis when it <br /> determines that such an exception will serve to further the purposes of the <br /> County's HOME Program and the effective and efficient administration of the <br /> HOME activities. The County may submit a request for an exception to HUD for <br /> consideration only after the Agency has provided to the County the following: <br /> a) A disclosure of the nature of the conflict, accompanied by an <br /> assurance that there has been public disclosure of the conflict <br /> and a description of how the public disclosure was made. <br /> b) An opinion of the Agency's attorney that the interest for which <br /> the exception is sought would not violate State or local law. <br /> 5. Factors To Be Considered for Exceptions <br /> The factors to be considered by the County to submit a request for an exception <br /> to HUD shall be the same as those considered by HUD in determining whether <br /> to grant a requested exception and are contained at 24 CFR 92.356(e). <br /> F. Fiscal Management. <br /> All disbursements under this Agreement shall be subject to audit and recovery of <br /> disallowed costs. <br /> 1. Payment and Disbursements. <br /> Disbursements by the County from this Agreement shall be on a reimbursement <br /> basis, covering obligations incurred but not paid by the Agency in its <br /> administration of the HOME activities. These funds shall be managed through <br /> the County's HOME Investment Trust Fund account utilizing the Integrated <br /> Disbursement and Information System (IDIS) described in 24 CFR Part 92.502, <br /> in the following manner: <br /> a) The Agency's staff will prepare all needed documentation to <br /> complete a HOME activity Set-up Report for each activity <br /> undertaken. <br /> b) The Agency's staff will prepare the Request for Payment to <br /> Snohomish County with adequate notice to allow processing by <br /> Snohomish County. <br /> 5 <br /> 46 <br />
