7 <br /> procedures of Title III of the Federal Uniform Relocation Assistance and Real <br /> Property Acquisition Policies Act of 1970 as amended (URA) and the regulations <br /> contained in 49 CFR Part 24 as well as 24 CFR 92.353. <br /> 2. Displacement, Relocation. <br /> (i) Agency hereby agrees to take all responsibility for <br /> expenses incurred due to relocation of households while <br /> Agency undertakes HOME activities. Agency expressly <br /> agrees to hold harmless and indemnify the County from <br /> any loss or claim of damages and from any expenses <br /> incurred related to the displacement or relocation of <br /> households as a result of HOME activities undertaken <br /> pursuant to this agreement. If relocation expenses <br /> should be incurred beyond the amount anticipated in <br /> proposal budgets, the Agency is responsible to pay for all <br /> such expenses associated with such HOME activities <br /> that exceed the budget. <br /> (ii) Any activities that result in the displacement of <br /> households must conform to 92 CFR Part 92.353. <br /> Before implementing any activity that may cause <br /> relocation or displacement of households, the Agency <br /> must submit a detailed Relocation Plan to the County <br /> Office of Grants Administration for review and approval. <br /> D. Lead-Based Paint <br /> All rehabilitation of residential property undertaken with HOME funding under this <br /> Agreement shall be subject to the Lead-Based Paint Poisoning Prevention Act <br /> (42 U.S.C. 4821 et seq.) and 24 CFR part 35. The lead-based paint provisions of <br /> ss 982.401(j) also apply, irrespective of the applicable property standard under <br /> ss 92.251. These regulations require the notification of all owners of properties <br /> built prior to 1978 of the hazards of lead-based paint. The notice will explain the <br /> symptoms of lead poisoning, and where chipping, cracking, or peeling surfaces <br /> are present, they will be made sound as part of the rehabilitation work. When <br /> required, testing for the presence of lead in a structure will be undertaken and <br /> the problem will be treated. <br /> The Agency must submit a Lead-Based Paint Plan to be reviewed and approved <br /> by the County Office of Grants Administration. <br /> E. Conflict of Interest <br /> 1. Applicability <br /> In the procurement of supplies, equipment, construction, and services by the <br /> Agency the conflict of interest provisions, as applicable, in 24 CFR 85.36 shall <br /> apply. In all cases not governed by 24 CFR 85.36 the provisions of this section <br /> shall apply. <br /> 2. Conflicts Prohibited <br /> No persons described in paragraph 3 of this section who exercise or have <br /> exercised any functions or responsibilities with respect to activities assisted with <br /> 4 - 45 <br />
