EVERETT CITY COUNCIL AGENDA ITEM COVER SHEET 9
PROJECT TITLE:
Consent COUNCIL BILL# (, -( -]
An Ordinance relating to X Action Originating Department Legal-Prosecutor
adoption of rules concerning 11/24/04 First Reading Contact Person Laura Van Slyck
the disposition of parking 12/1/04 Second Reading Phone Number 257-8738
violations in the City of 12/8/04 Third Reading FOR AGENDA OF 11/24/04, 12/1/04,
Everett,Amending Section 33 12/8/04
of Ordinance No. 2180-96 Public Hearing
(EMC 46.28.330). Initialed by:
Department Head
CAA
Council President jj-
Location Preceding Action Attachments Department(s) Approval
Proposed Ordinance
Amount Budgeted 0
Expenditure Required 0 Account Number(s):
Budget Remaining 0
Additional Required 0
DETAILED SUMMARY STATEMENT: Under current City parking laws, when a parking infraction is issued it
represents a determination that a parking violation has been committed. This determination is final unless contested
as provided in Chapter 46.28 EMC. Upon receipt of the notice of parking infraction, the registered owner of the
vehicle must respond to the notice within 15 days by either requesting a hearing in Everett Municipal Court or
completing the appropriate portion of the infraction and submitting it with payment of the fine. An administrative
process for vacating a parking infraction would be appropriate when a notice of parking infraction has been issued
and, subsequently, circumstances become sufficiently clear to show that the parking infraction should be vacated.
This proposed ordinance allows the police department and/or municipal court to develop and implement this
administrative process.
RECOMMENDATION (Exact action requested of Council): Adopt an ordinance relating to adoption of
rules concerning the disposition of parking violations in the City of Everett,Amending Section 33 of
Ordinance No. 2180-96 (EMC 46.28.330).
a9
