0 <br /> '-_ <br /> Ordinance No. <br /> An Ordinance relating to adoption of rules concerning the disposition of parking <br /> violations in the City of Everett, Amending Section 33 of <br /> Ordinance No. 2180-96 (EMC 46.28.330) <br /> Whereas,under the current City of Everett parking regulations, issuance of a notice of <br /> parking infraction represents a final determination that a parking violation has been <br /> committed; and <br /> Whereas,under the current City of Everett parking regulations, the means of responding <br /> to a notice of parking infraction are limited to payment of the infraction or request for a <br /> contested hearing or mitigation hearing regarding the infraction; and <br /> Whereas there are some circumstances where it is sufficiently clear that the notice of <br /> parking infraction should be vacated that an administrative process for vacation of the <br /> infraction is appropriate and would be advantageous to those citizens who have been <br /> issued notices of parking infractions under these circumstances; and <br /> Whereas the Everett City Council deems it appropriate for such an administrative <br /> process to be developed and implemented; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 33 of Ordinance No. 2180-96 (EMC 46.28.330), which reads as <br /> follows: <br /> Rules and regulations. <br /> The Everett municipal court, city treasurer's office and the city's police department are <br /> authorized to promulgate rules and regulations necessary to administer this chapter. <br /> Be and the same is hereby amended to read as follows: <br /> Rules and regulations. <br /> Notwithstanding other provisions of this Chapter, the Everett municipal court, city <br /> treasurer's office and the city's police depallnient are authorized to promulgate rules and <br /> regulations necessary to administer this chapter including the administrative vacation of <br /> parking infractions where circumstances support the administrative vacation thereof. <br /> Section 2: General duty. <br /> It is expressly the purpose of this ordinance to provide for and promote the health, safety <br /> and welfare of the general public and not to create or otherwise establish or designate any <br /> particular class or group of persons who will or should be especially protected or <br /> bfl <br />
