(2) "Hispanic Americans,"which includes persons of Mexican, Puerto
<br /> Rican, Cuban, Dominican, Central or South American, or other
<br /> Spanish or Portuguese culture or origin,regardless of race;
<br /> (3) "Native Americans,"which includes persons who are American
<br /> Indians, Eskimos, Aleuts, or Native Hawaiians;
<br /> (4) "Asian-Pacific Americans,"which includes persons whose origins are
<br /> from Japan, China, Taiwan, Korea, Burma(Myanmar), Vietnam, Laos,
<br /> Cambodia (Kampuchea), Thailand, Malaysia, Indonesia, the
<br /> Philippines, Brunei, Samoa, Guam, the U.S. Trust Territories of the
<br /> Pacific Islands, Macao, Fiji,Tonga, Kirbati, Juvalu,Nauru, Federated
<br /> States of Micronesia, or Hong Kong;
<br /> (5) "Subcontinent Asian Americans," includes persons whose origins are
<br /> from India, Pakistan, Bangladesh, Bhutan, Maldives Islands,Nepal, or
<br /> Sri Lanka;
<br /> (6) Women;
<br /> (7) Any individual groups whose members are designated as socially and
<br /> economically disadvantaged by the SBA, at such time the SBA
<br /> designation becomes effective.
<br /> c. DBE Obligation: The City of Everett(Everett Transit) has established an
<br /> aspirational goal for DBE participation of 2% of the total dollar amount of annual
<br /> contracts. Contract award will be made only to bidders who have made a good faith
<br /> effort to meet the goal. The contractor or subcontractor shall not discriminate on the
<br /> basis of race, color, national origin, or sex in the performance of this contract. The
<br /> contractor shall carry out applicable requirements of 49 CFR Part 26 in the award and
<br /> administration of Federal Transit Administration-assisted contracts. Failure by the
<br /> contractor to carry out these requirements is a material breach of this contract,which
<br /> may result in the termination of the contract or such other remedy as the City of
<br /> Everett deems appropriate.
<br /> d. Good Faith Efforts: Meeting the aspirational goal will constitute good faith effort.
<br /> In order for the City of Everett(Everett Transit)to make a good faith effort
<br /> determination, bidders will be required to submit the DBE statements and certifications
<br /> at Appendix A of this Volume. If a bidder does not meet the aspirational goal, the
<br /> bidder will be required to furnish documentation showing the good faith efforts made to
<br /> achieve the aspirational goal. The City of Everett(Everett Transit)will review the steps
<br /> taken by the bidder to establish if such steps represent good faith efforts that could
<br /> reasonably be expected to result in DBE participation in accordance with 49 CFR Part
<br /> 26.
<br /> e. Reconsideration: If the City of Everett (Everett Transit) determines the apparent
<br /> lowest responsive and responsible bidder did not make good faith efforts, the bidder
<br /> shall be so notified. Within five (5) business days of such notification the bidder may
<br /> request administrative reconsideration in writing to the City of Everett Finance Director,
<br /> who is the reconsideration official. The reconsideration official shall not have had any
<br /> role in the original determination of failure to document good faith efforts. The bidder
