2 <br /> will have the opportunity to provide additional written documentation or argument <br /> concerning the issue of whether adequate good faith efforts were made to meet the <br /> aspirational goal. The bidder will have the opportunity to meet with the reconsideration <br /> official to discuss its case. The bidder will be informed in writing of the reconsideration <br /> decision, explaining the basis of finding. The decision of the reconsideration official will <br /> be final and cannot be administratively appealed to the Department of Transportation. If <br /> the determination that a good faith effort has not been made by the apparent lowest <br /> bidder is upheld,a contract will not be awarded to that bidder. In such an event, the <br /> efforts of the next responsive and responsible bidder(s) shall be reviewed until a <br /> successful good faith effort determination can be made and a contract can be awarded, or <br /> all bids will be rejected. <br /> f. Criteria for Determining Good Faith Efforts: <br /> (1) Adequate solicitation of DBEs through all reasonable and available means, <br /> with sufficient time for DBEs to respond to the solicitation. <br /> (2) Selecting portions of the work to be performed by DBEs in order to increase <br /> the likelihood that the DBE goals will be achieved. <br /> (3) Providing interested DBEs with adequate information about the plans, <br /> specifications and requirements of the contract in a timely manner. <br /> (4) Negotiating in good faith with interested DBEs. Any additional cost in finding <br /> and using DBEs is not in itself sufficient reason for a bidder's failure to meet <br /> the goal, as long as costs are reasonable. Prime contractors are not required to <br /> accept higher quotes from DBEs if the price difference is excessive or <br /> unreasonable. <br /> (5) Not rejecting DBEs as being unqualified without sound reasons based upon a <br /> thorough investigation of their capabilities. <br /> (6) Making efforts to assist interested DBEs in obtaining bonding, lines of credit, <br /> or insurance as required by the City of Everett or the contractor. <br /> (7) Making efforts to assist interested DBEs in obtaining necessary equipment, <br /> supplies, materials, or related assistance or services. <br /> (8) Effectively using the services of available minority/women community <br /> organizations and other organizations to provide assistance in the recruitment <br /> and placement of DBEs. <br /> APPENDIX A <br /> DISADVANTAGED BUSINESS ENTERPRISE STATEMENT <br /> 49 CFR Part 26 <br /> To be eligible for contract award, bidders must execute and submit with their bid this <br /> statement regarding Disadvantaged Business Enterprises (DBEs). This statement shall be <br /> deemed a factor in the City of Everett's evaluation of this bid.
